Privacy Policy

Inspiritive appreciates that privacy is an important personal and legal consideration, and personal records must be protected from misuse or unauthorised dissemination. Inspiritive is aware that providing private or business information is an act of trust.

The privacy of personal records will be respected. Any information gathered is for the purpose of informing the owner of the data about Inspiritive's business activities or for recording students' progress. This data will kept updated at regular intervals and stored in secure conditions to be accessed only by Inspiritive personnel and contracted agents. Any contracted agent will have agreed that their access to private information is solely for their use for and on behalf of Inspiritive in the course of conducting Inspiritive's legitimate business. This information is not for use in any other context nor is it available to any other party except law enforcement agencies when they present with properly executed warrants.

Each person for whom Inspiritive holds records has the right to determine the use to which those records are put. Inspiritive will not provide personal details to any third party without consent. Where that person is offered the opportunity:

  1. to be listed as a member of a class list of social contacts from a seminar they attend

  2. to be informed by a third party about a specific related activity, e.g. a practice group

  3. to provide private information to any person or organization introduced by Inspiritive in the course of providing information, goods or services

that individual has the right to accept or refuse that offer and their decision is binding.

Any seminar class list is made available only to consenting members of that program on condition that that class list is used only by those parties listed on it and only for the purpose of maintaining social contact with those parties. Any commercial or other use of part or all of such a list is unlawful.

Any practice group or its organiser to which or whom a person is introduced by or through Inspiritive is specifically enjoined only to provide information directly concerning the activity of the practice group. Dissemination of commercial activity by a practice group or its organiser to members of that group who were introduced with their consent by Inspiritive is unlawful.

Members of a class list, practice group, or other person or organization introduced to that organization with their consent by Inspiritive may from time to time ask for specific commercial use of the private details they have provided to the third party. In the event that this occurs, the organiser of the event or transaction in question shall:

  1. Inform the member that such action will place them in breach of Inspiritive's terms for making the introduction.

  2. Inform Inspiritive that a person or persons introduced by Inspiritive has sought to receive commercial information from the organization

  3. Provide the names of all persons introduced by Inspiritive who are taking up a commercial offer

  4. Acknowledge to Inspiritive that receipt of commercial information by a person or persons introduced by Inspiritive places the organization in breach of its agreement to use names introduced by Inspiritive solely for the stated purpose only

and either

  1. Seek consent from Inspiritive to provide those individuals with the information, goods and services they seek subject to such terms and conditions as Inspiritive may impose

    or

  2. Undertake to continue to uphold the original terms and conditions pertaining to the introduction by Inspiritive.

Inspiritive will not withhold consent unreasonably where the proposed commercial activity is of a different type from Inspiritive's normal business as deemed by Inspiritive.

As Inspiritive does not meet the criteria for binding corporate entities under existing privacy legislation in Australia, Inspiritive undertakes to comply with the voluntary National Principles for the Fair Handling of Personal Information developed by the Australian Federal Privacy Commissioner in 1998 (www.privacy.gov.au). As a Registered Training Organization Inspiritive will comply with any laws enacted in support of consumers' privacy.

Inspiritive will only collect or monitor personal information about people with their consent in order to provide the information, goods or services requested by them or because it is a legal requirement to collect that information or because that information is in the public domain.

Inspiritive will take all reasonable steps to keep secure any data held on individuals and organizations and to keep this data accurate and up to date. The information will be stored on secure servers. Inspiritive personnel and agents are required to keep any personal information confidential, however Inspiritive will not be held responsible for events arising from unauthorised access to personal records.

Where a client requests a non-disclosure agreement, Inspiritive will consider each case on its merits subject to the law of the country in which the agreement is made and the known values of the parties to the agreement. All lawful efforts will be made to honour any such agreement for the duration of its existence.

Inspiritive.com.au, Inspiritivelife.com.au and Inspiritiveconsulting.com provide links to web sites outside the company. These linked sites are not under Inspiritive's control and Inspiritive is not responsible for the conduct of organizations linked to its web sites. Before disclosing your personal details on any other web site, you are advised to view the terms and conditions for using those web sites.

This web site will change as new information becomes available and statutory requirements for RTOs are updated. Currently Inspiritive's policies will be reviewed at least annually and may be revised at any time. Inspiritive reserves the right to change its privacy policy at any time and to notify you by posting an updated version of the this website.
